RULES OF PROCEDURE IN COURT

A. GENERAL RULES OF ORDER

The court has guidelines regarding the rules of procedure that must be obeyed by everyone who enters the court building:

  1. The Chief Justice is responsible for maintaining order among all parties present in the courtroom. Everyone present must obey all orders issued by the Chief Justice.
  2. Everyone present in the courtroom must always show respect for the court. If any party fails to show respect for the court, the Chief Justice may order that individual removed from the courtroom and may even face criminal prosecution.
  3. Wear modest clothing.
  4. Speak in a clear voice when a judge or legal advisor asks a question, so that the other judges can hear clearly.
  5. Addressing a judge as "Your Honour" and a legal advisor as "Legal Advisor"

The following items are not permitted to be brought into the courtroom:

  1. Firearms
  2. Sharp Objects
  3. Explosives
  4. Equipment or various objects that could endanger the security of the courtroom.

Security officers may search anyone suspected of possessing one or more of the items listed above. Anyone found carrying any of these items will be asked to deposit them in a designated storage area outside the courtroom. Upon leaving the courtroom, security officers may return the items. Visitors found bringing any of these items into the courtroom may be subject to criminal charges.

  1. It is prohibited to make noise, either inside or outside the courtroom.
  2. Sit neatly and politely during the trial
  3. Dilarang makan dan minum di ruang sidang.
  4. Smoking is prohibited both in the courtroom and inside the court building.
  5. It is mandatory to turn off your cell phone while in the courtroom.
  6. It is prohibited to bring children under the age of 12 years, unless the Panel of Judges wishes the child to attend the trial.
  7. Throw garbage in its place.
  8. It is prohibited to post announcements or brochures in any form in the court building without written permission from the Chief Justice.
  9. Please ask permission first from the Panel of Judges before recording with a camera, tape recorder or video recorder.

Visitors who come to the courtroom to watch the proceedings, but are not witnesses or involved in the trial, are expected to comply with the following provisions:

  1. Must respect the institution of the Court as mentioned above.
  2. Must comply with all the rules and regulations mentioned above.
  3. It is prohibited to talk to other visitors during the trial.
  4. It is prohibited to speak in support of or raise objections to the testimony given by witnesses during the trial.
  5. It is prohibited to provide comments/suggestions/responses to anything that occurs during the trial without the permission of the Panel of Judges.
  6. It is prohibited to speak loudly outside the courtroom which could cause sound to enter the courtroom and disrupt the proceedings.
  7. It is prohibited to enter and leave the courtroom for unnecessary reasons because it will disrupt the course of the trial.
  8. Visitors who wish to enter or leave the courtroom must ask permission from the Panel of Judges.

There are several additional rules of procedure that must be followed in criminal trials, namely:

  1. If you are a witness or defendant who is not being detained, please arrive 15 minutes before the scheduled time.
  2. The parties are required to report their presence to the Deputy Clerk and to the Prosecutor handling the case.
  3. Before the court hearing begins, the clerk, public prosecutor, legal counsel, and attendees must be seated. Everyone must stand when the panel of judges enters and leaves the courtroom.
  4. Witnesses are called one by one into the courtroom, as decided by the Chief Justice, after hearing input from the Public Prosecutor and the defendant or the defendant's legal counsel. After a witness has given his testimony, he or she is required to sit in the visitor's area and listen to the testimony of the other witnesses. A witness may leave the courtroom after obtaining permission from the Chief Justice, unless the Public Prosecutor or the defendant or the defendant's legal counsel wishes the witness to remain in the courtroom.

B. PROCEDURES FOR THE TRIAL

  1. When the Panel of Judges Enters and Leaves the Courtroom, all those present stand to show respect.
  2. During the trial, visitors to the trial must sit politely and orderly in their respective places and maintain order in the courtroom.
  3. Visitors to the court are prohibited from eating, drinking, smoking, reading newspapers, or carrying out actions that could disrupt the course of the trial (cell phones must be turned off/not making or receiving calls via cell phone). In the courtroom, everyone must show respect to the court.
  4. Everyone is prohibited from bringing firearms, sharp weapons, explosives, or tools or objects that could endanger the security of the trial and anyone who brings them must leave them in a place specifically provided for this, namely at the Junior Criminal Court Clerk;
  5. Everything ordered by the Chairperson of the Session to maintain order in the session must be carried out immediately and carefully.
  6. Without a warrant, a Court Security Officer, due to his/her official duties, may conduct a Body Search to ensure that a person present in the courtroom is not carrying weapons, materials or tools or objects that could endanger the security of the court.
  7. Taking photos, sound recordings, or TV recordings must first obtain permission from the Chief Judge of the Court.
  8. Anyone in a court session who behaves in a manner inconsistent with the dignity of the Court and does not comply with the Rules of Procedure of the Court, and after the Chief Judge of the Court has given a warning, still violates the Rules of Procedure, then on the orders of the Chief Judge of the Court, the person concerned will be removed from the courtroom and if the violation of the rules of procedure in question is of a criminal nature, this will not reduce the possibility of prosecution of the perpetrator.
